Terms of Use

These Terms govern use of CaldravaInstruments.com, its public-source intelligence preview, machine-readable feeds, controlled demonstrations, and access-request workflow (collectively, the “Services”). By using the Services, you agree to these Terms. If you use them for an organization, you represent that you have authority to bind that organization.

Public, defensive, and non-official scope

The public preview is an informational, defensive catalog of reviewed public-source metadata. It is not an official government product, emergency service, dispatch system, operational command system, comprehensive monitoring service, or automated attribution system. Do not rely on it for emergency response, navigation, life-safety, legal, medical, or investment decisions.

Eligibility and authority

You must be legally capable of agreeing to these Terms. A person requesting organizational, evaluation, or enterprise access must use accurate information and must be authorized to make the request. The public Services are not directed to children under 13.

Requests and controlled access

An access request is an application for review only. It does not create an account, contract, entitlement, partnership, procurement commitment, or access grant. Caldrava may verify the request, require additional terms, decline it, or revoke demonstration access at any time. Commercial access begins only under a signed agreement or an expressly issued, unexpired credential.

Unsolicited ideas and submissions

Caldrava does not accept ideas, proposals, concepts, suggestions, designs, product plans, code, data, or other materials in confidence unless a prior written agreement signed by Caldrava expressly says otherwise. Do not submit material you expect Caldrava to keep confidential, treat as proprietary, or compensate you for receiving or using.

If you voluntarily provide an unsolicited idea or other submission through the Services or a Caldrava contact channel, the submission is non-confidential. You retain any ownership you may have, but you grant Caldrava, its affiliates, successors, and assigns a perpetual, irrevocable, worldwide, nonexclusive, royalty-free, fully paid, transferable, and sublicensable license to retain, use, reproduce, modify, adapt, publish, distribute, display, perform, develop, make, have made, sell, offer for sale, import, commercialize, and otherwise exploit the submission for any lawful purpose and in any media. Caldrava has no obligation to review, use, acknowledge, attribute, compensate, account for, respond to, or return a submission, and may already be developing the same or a similar idea.

You represent that you have the rights necessary to make the submission and grant this license. This section does not override a signed written agreement and does not convert a legal notice, privacy or data-rights request, accessibility request, or good-faith security report into an idea submission merely because it is sent through the same form.

Credentials and security controls

Credentials are personal to the authorized recipient. You may not share, sell, transfer, replay, reverse engineer, or attempt to extend them; bypass rate limits, authentication, authorization, geographic restrictions, or other controls; probe nonpublic endpoints without written authorization; or use an expired or altered credential.

Acceptable use restrictions

You may not interfere with the Services; introduce malicious code; overload or disrupt infrastructure; access restricted systems or data without authorization; reidentify people from de-identified information; use the Services to stalk, harass, discriminate against, threaten, or target a person; publish protected telemetry or sensitive locations; control a third-party system; misrepresent affiliation or source provenance; or violate law, contractual duties, source licenses, robots instructions, or publisher terms.

Reasonable automated retrieval of an expressly published machine-readable feed is permitted subject to its documented refresh floor, caching instructions, these Terms, and original-source restrictions. Automated collection from any other Caldrava surface requires written permission.

Source records and corrections

The named source remains the original publisher. Caldrava publication does not alter the source, create government affiliation, or replace publisher guidance. Metadata can be delayed, incomplete, corrected, superseded, or withdrawn. Report a provenance or accuracy concern through the request form and select “Other controlled access.”

Intellectual property and licenses

Caldrava branding, software, design, compilations, documentation, and original analysis are owned by Caldrava Instruments of America or its licensors. No rights are granted except the limited right to use the Services under these Terms. Public-source and third-party materials remain governed by their original rights, notices, and licenses. Privacy

The Privacy Policy describes information processed through the public site, demonstrations, optional location workflow, security logs, and access requests. Do not submit credentials, classified information, protected telemetry, personal records, or data you are not authorized to disclose.

Suspension and termination

Caldrava may restrict or terminate access to protect users, sources, systems, or legal obligations; investigate suspected misuse; preserve evidence; or enforce these Terms. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limitations, and source restrictions—continue to apply.

Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of accuracy, completeness, merchantability, fitness for a particular purpose, noninfringement, uninterrupted operation, or compatibility. Nothing here limits a warranty that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, Caldrava and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, data, goodwill, or business interruption; or decisions made in reliance on the Services. Any liability that cannot be excluded is limited to the amount paid for the affected Service during the preceding 12 months, or US $100 if no amount was paid.

Indemnification

If you use the Services for an organization, you agree to defend and indemnify Caldrava against third-party claims arising from your unlawful use, violation of these Terms, infringement of third-party rights, or unauthorized data submission, except to the extent prohibited by law.

Trade controls

You may not use, export, or re-export the Services in violation of applicable sanctions, export-control, or import laws. Restricted access may require identity, organizational, location, and end-use verification.

Governing terms and disputes

An executed agreement controls where it conflicts with these public Terms. Otherwise, applicable law governs without displacing mandatory consumer rights. Before filing a non-emergency claim, send a written dispute notice through the request form so the parties can attempt informal resolution. Nothing restricts lawful reports to regulators or emergency services.

Changes and severability

Caldrava may update these Terms by posting a new effective date. Material changes apply prospectively unless law requires otherwise. If a provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver.
